FLSA rate of pay decision

"AFGE is pleased to announce that we have prevailed before the Arbitrator on the LEO rate of pay issue. The Agency argued that AUO eligible LEO personnel that will be receiving FLSA backpay pursuant to AFGE's previous victories in this case should only be paid at the AUO rate of pay (25% of the regular hourly rate) instead of the FLSA rate of pay (150% of the regular hourly rate). After both a hearing and lengthy briefing on this complex legal issue, AFGE has prevailed and the arbitrator has found that 150% of the regular hourly rate is the proper rate of pay for our LEO claimants for Suffer or Permit overtime. A copy of the Arbitrator's award is provided in PDF format for your information.
I expect that the Agency will do all it can to delay proper payment but be assured that AFGE is fighting on your behalf and doing everything possible to get you properly and timely paid for your overtime.
