DoD National Security Personnel System Dramatically Reduces the Scope of Bargaining for Employee Representatives The purpose of this paper is to compare the scope of bargaining under the DoD NSPS draft regulations to the current scope of bargaining under Chapter 71, Title 5, U.S. Code. The paper will show the change in relation to five important workplace issues: overtime policy, shift rotation for employees, safety and health programs, flexitime and alternative work schedules, and deployment away from regular work locations. Defense Workers Hold News Conference/Rally to Protest Impending DoD Personnel Changes Washington—Hundreds of federal employees from the Department of Defense (DOD) today rallied and then marched to Capitol Hill to protest the proposed implementation of the National Security Personnel System (NSPS) within DOD. Defense Conference Notice AFGE’s Defense Conference (DEFCON) allows for the voluntary participation of DOD locals in serving as an activist group committed to using the collective strength in representing federal employees. The leadership of this group, the DEFCON Steering Group, serves as an advisory group to AFGE’s National President and as part of the NEC’s Defense Committee. [full notice | DEFCON Agenda] 1-5-2005
NSPS Update [On December 14, 2004] our DoD team, which included National Vice President Swanke, DEFCON Leaders and General Counsel Mark Roth, met with DoD along with the other unions.
DoD advised that their “proposed” regulations are likely to be published in early to mid January. They have refused to provide any substantive information on the direction they are heading.
The publication will begin a 30 day period for written public comment. AFGE will comment. We will do a quick analysis and distribute via web and email so that locals can comment as well. We also intend to do a summary for locals to pass out to every DoD employee. In a perfect world, every employee in DoD should register a comment. We expect the agency will provide a web site for anyone to use for comment purposes. Our goal should be to get as close to perfection as possible.
In addition, all other AFGE locals should be prepared to organize/mobilize their members/bargaining unit employees during this 30 day period as well to generate comments from outside DoD. What happens in DoD will likely be applied to the rest of the government. This comment period will be the critical time for the rest of our members in other units to weigh in.
We also were given information on the first group to be placed under pay for performance (copy attached). Please advise all of your locals as soon as possible.

DoD Personnel System (NSPS) Design and Implementation Plan (Members Only) by NP John Gage On April 19 the unions received a short briefing from Secretary England outlining a general process leading to the development and implementation of the NSPS. The attached material provides some information, but leaves many questions unanswered. Secretary England left for another meeting having only taken a couple of questions. His question for the unions was to describe what we envisioned as our role in the process. The unions will get together sometime next week to discuss the matter in general before responding to DoD. information charts 4-20-2004
Fight PrivatizationAttention DoD Locals Have any jobs at your location performed by military personnel been taken over by contractors without federal employees having a chance to compete for the jobs? It is AFGE's understanding that DoD is required by the new Circular A-76 to allow federal employees to compete for these jobs.
Contractor Cost Tracking (Members-Only) When government work is contracted out to private companies, it is often surmised that this new arrangement will save the government money. This is not always the case. In an effort to track the actual costs of contracts, AFGE has made available some resources to allow AFGE members to get these actual cost figures from agencies. |
