As I hope you have heard, AFGE filed a lawsuit on December 31, 2018 against the government over the current shutdown. For this case AFGE has partnered with Heidi Burakiewicz of the law firm Kalijarvi, Chuzi, Newman & Fitch, who brought the same claims against the government during the 2013 shutdown and who won that case.
Our current lawsuit was filed on behalf of all federal employees who are performing work without pay during the shutdown. We are sending this message to let you know that AFGE has you covered. Our plan, with the lawyers we have retained for this fight, is to represent you in this matter if you’re working without pay at any time during the shutdown.
You do not need to take any action at this time to be included. In the coming days, we plan to circulate an electronic sign-up process so that employees can start submitting paperwork to join the case.
We discovered recently that, unfortunately, other law firms are contacting employees in hopes of filing a copycat lawsuit. We are not working with these other firms and cannot vouch for them. As mentioned above, AFGE has already agreed to work with Heidi Burakiewicz and Kalijarvi, Chuzi, Newman & Fitch given her successful litigation of the 2013 case. She and her firm have decades of experience representing federal employees and working with unions. You do not need to retain another law firm to address the government’s FLSA violations during the shutdown. Again, we have you covered.
