AFGE Local 4060, which represents FEMA employees nationwide, has just won a settlement worth $16.5 million for former and current employees who worked overtime but did not get paid for it.
The settlement is part of a Fair Labor Standards Act (FLSA) overtime grievance the local filed against FEMA years ago. FLSA establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting workers in both public and private sectors.
“This is a great victory for our union and FEMA employees,” said AFGE Local 4060 President Steve Reaves. “Your union leadership, both past and present, worked hard for many years to reach this settlement on your behalf. In celebrating this huge victory, we remind you that this is just one of our many important successes in recent years, and we encourage you to become a member of AFGE.”
The bulk of $16.5 million will be distributed by the Class Action Implementation Group (CAIG), an organization that administers claims processing for class action cases, to eligible former and current employees.
Those eligible for any payment will be determined based on various factors and relevant data – some of which still needs to be assembled and provided by FEMA to the union, its attorneys, and CAIG. The process is expected to take several months.
